Michael Kahn

Michael Kahn practices law with substantial experience in First Amendment ordinance preparation and litigation, complex civil litigation in state and federal courts, and corporate transactions. In 2005, he completed a complex trial regarding trade secrets and contract issues concerning the United States Space Shuttle. He has tried several other large and complex intellectual property cases, including cases involving copyright and trade secrets regarding computer software. See, for example, Bateman v. Mnemonics, 79 F.3d 1532 (11th Cir. 1996).

For approximately the past 28 years, Mr. Kahn has acted as Special Counsel to various Florida cities and counties with regard to both the preparation of ordinances and defense of ordinances involving First Amendment issues. He has written ordinances for regulation of adult entertainment, street performers, street vendors, panhandling, and outdoor public assemblies. For example, as Special Counsel for the City of St. Augustine, he wrote, defended, and ultimately prevailed in the Eleventh Circuit to a challenge to an ordinance regulating street performers. See Horton v. City of St. Augustine, 272 F.3d 1318 (11th Cir. 2001). Mr. Kahn is a Supreme Court Certified mediator who has been appointed by several state and federal judges to mediate First Amendment disputes.

Mr. Kahn has been engaged in the private practice of law since 1977. He received his law degree from Duke University in 1977. He also holds a Master of Arts from Emory University and a Master of Arts in Teaching Degree from the University of Florida. He was an adjunct professor at Rollins College teaching courses, among others, on the law of the First Amendment. He won the Christa McAuliffe Teaching Award in 2002. Currently, he is teaching Constitutional Law I and II for Florida Institute of Technology.
