On February 11, 2014, Nichole Rogers* was violently attacked in the waiting room of a children’s hospital diabetes clinic. A 16-year-old with a documented history of violence assaulted Nichole, causing a traumatic brain injury (TBI), PTSD, and severe trauma for her children, who witnessed the attack.

Security had agreed the assailant wouldn’t be allowed at the clinic, but this agreement was ignored. The attack exposed systemic failures in the hospital’s security protocols. Despite $26 million in insurance coverage, the hospital refused to mediate, forcing a contentious trial.

Randy Rozek, using expert evidence of systemic negligence, successfully reframed Nichole’s story—not as a victim, but as a survivor whose resilience compelled jurors to act.
