Dr. Herbst is a board certified M.D. radiologist with a Ph.D. in physical chemistry who completed a fellowship in MRI and is now practicing in St. Petersburg, Florida. He is a nationally known expert in MRI, but he reads all kinds of medical images in his clinical practice, including x-rays, CT scans, ultrasounds, and nuclear medicine scans, specializing in musculoskeletal radiology and neuroradiology. He is a senior member of the American Society of Neuroradiology.

Dr. Herbst has taught MRI physics to technologists at St. Petersburg College, radiology to medical students from University of South Florida, Lake Erie College of Osteopathic Medicine, Nova Southeastern University College of Osteopathic Medicine, and Edward Via College of Osteopathic Medicine, and image interpretation skills to resident physicians and fellows in the Obstetrics/Gynecology, Sports Medicine, and Family Practice programs at Bayfront Medical Center in St. Petersburg.

Dr. Herbst also lectures to physicians, attorneys, and insurance case managers around the country about radiology subjects such as MRI, radiology errors, disc herniations, and brain injury.

Attorneys from the United States and Canada send medical images to Dr. Herbst for his unbiased review. As a pre-trial consultant, he tells attorneys what the images show and perhaps just as important, what they do not show, which helps plaintiff and defense attorneys alike decide how to move forward with their malpractice or personal injury cases.

Since 2018, Dr. Herbst has limited his attorney review work to those that include brain imaging of some kind. In those cases, he will review and testify about the brain imaging and also about any other imaging studies provided, so the attorney would not have to hire another radiologist for the non-brain images. Occasionally, he will consider taking on other cases that do not involve brain studies, if they involve egregious malpractice, unusual circumstances, are part of complex civil or criminal cases, or contain especially interesting imaging findings.

Lance D. Lourie graduated from Tulane University with a Bachelor of Arts in 1982, and received his J.D. degree in 1985 from the University of South Carolina.

While in law school, Mr. Lourie served on the South Carolina Law Review and the National Moot Court Team. He is admitted to the Georgia and Tennessee Bars.

Mr. Lourie was a partner with a defense firm, where he practiced from 1985 to 1997. During that time, his primary area of practice was the defense of medical malpractice, general liability, and civil rights cases.

In 1997, Mr. Lourie left his defense practice, and became a partner with the firm of Watkins, Lourie, Roll & Chance, PC. Mr. Lourie’s practice focuses on the handling of plaintiff’s medical malpractice, nursing home, and general liability cases. Mr. Lourie served a number of years as a Vice President at Large, as well as on the Executive Committee, of the Georgia Trial Lawyers Association.

Mr. Lourie has been designated as a top-rated lawyer by Super Lawyers. He is also rated by Martindale-Hubbell as AV Preeminent, which is the highest rating for ethics and ability. Mr. Lourie spends his professional time litigating and trying personal injury cases.

He is a frequent writer and lecturer at numerous Continuing Legal Education seminars relating to trial tactics, medical malpractice cases, nursing home cases, general liability cases, civil rights cases, and other litigation matters.

Camille Godwin has more than twenty years of experience litigating a variety of issues throughout the country, including cases involving professional negligence, nursing home abuse, multi-state civil rights, inadequate security, products liability, toxic torts, and commercial disputes.

Through these experiences on both the trial and appellate levels, Camille developed a deep understanding of the complicated corporate structures, financial arrangements and organizational agreements that typify much of the health care industry and related business sectors. She brings all this experience to bear in her role as managing attorney for Eric J. Hertz, P.C., a firm proud to focus our work on helping the victims of nursing home abuse and neglect throughout the southeast.

Since 2009, Michael has devoted the majority of his practice to representing vulnerable people and their families who have been harmed by abuse or neglect in nursing homes, assisted living facilities, group homes, and hospitals.

Michael is one of a select few lawyers in New Jersey who truly concentrate their practice to this area. Michael shares his knowledge on this important topic by regularly lecturing around the country and teaching other lawyers to prosecute these claims the right way. He has been published many times, including in the New Jersey Law Journal and in “Trial”, the attorney magazine published & disseminated nationally by the American Association for Justice.

He currently serves on the Executive Board of the national Nursing Home Litigation Group for the American Association for Justice.
Michael brings a unique perspective to his work. He himself has lost family members in institutions and he knows, first-hand, what it’s like to see someone you care about struggle and die. He uses that passion and understanding to bring about justice for his clients.
Michael is a highly skilled and dedicated advocate. Prior to entering private practice, Michael served as a Judge Advocate in the United States Air Force, where he tried many cases all over the world, including Japan, Qatar and Kuwait.

Michael was lead counsel for the plaintiff in the case of Dwyer v. Harborview, which generated the largest nursing home verdict to date in the state of New Jersey: $13.2 Million. While the verdict was later the subject of post-trial motions and an appeal, and ultimately settled for a different amount on appeal, the results demonstrate Michael’s considerable skill in the courtroom. Please note, every case is unique and no specific case or outcome can predict future results.

Ms. Valentine has dedicated her career in the practice of law to advocating for the vulnerable elderly, injured and the infirm. Her clients ages span from newborn children to elderly as old as 104. She practices predominately in the areas of elder abuse and medical malpractice.

Ms. Valentine is an Associate with the American Board of Trial Advocates. She has twice been the Orange County Trial Lawyers Association’s Top Gun award recipient as the top Elder Abuse litigator. She was also recognized in 2008 as a California Trial Lawyers Associations “Street Fighter” Award finalist. She was also named a Super Lawyer each year from 2014 through present. Super Lawyers Southern California Magazine also named her as one of the top 50 Orange County lawyers and Top 50 Women lawyers in Southern California in 2017 and 2018.

She serves on the Board of Governors for the Consumer Attorneys of California. Ms. Valentine served on the Board of Directors for the Orange County Trial Lawyers Association from 2007 through 2011. She is also a member of CAALA, OCTLA, OCBA, the American Association for Justice and the American Jurist Association.

Ernest was born at Hill Field, Air Force Base in Utah. At the age of two his family moved to Hickam Air Force Base in Hawaii. When he was five his father retired from the Air Force and the family moved to Lubbock, Texas.

Ernest attended Texas Tech University and received a bachelor’s degree in Finance in 1987. He then attended Texas Tech University School of Law and received his Juris Doctorate in 1990. Upon graduating from law school, Ernest moved to the Dallas/Ft. Worth area to work for the Tarrant County District Attorney’s Office. Ernest worked there until 1993, at which time he entered private practice.

Now leading the Tosh Law Firm, Ernest limits his practice to nursing home abuse and neglect cases. Ernest regularly consults with attorneys throughout the United States on cases involving nursing home neglect and abuse. He is licensed to practice in Texas and is available to practice in any state on a case by case basis. Ernest has extensive trial experience; having tried over 150 jury trials to verdict and has recovered millions of dollars from nursing homes that take advantage of our elderly.

Ernest is a member of the American Association for Justice and the American Association for Justice Nursing Home Litigation Group. Ernest is also a member of the American Bar Association and the Texas Trial Lawyers Association.

Ernest is a frequent lecturer on forensic accounting in nursing home litigation and has testified numerous times as an expert in this area.
When not working on legal matters, Ernest enjoys activities with his family; his wife of 29 years Tommye and their three children. Ernest is an avid long distance swimmer and swims open water courses whenever possible.

Mark Kosieradzki is a nationally recognized trial lawyer from Minneapolis MN. His 40-year career has spanned a vast array of cases throughout the United States.
